1. Introduction and Acceptance of Terms

Welcome to Dockpage ("Company," "we," "us," or "our"), an AI-powered personal website generation platform accessible at dockpage.io (the "Service"). By accessing or using the Service in any manner, including but not limited to visiting or browsing the website, uploading content, or generating a personal website, you ("User" or "you") agree to be legally bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you must immediately discontinue your use of the Service.

These Terms constitute a legally binding agreement between you and Dockpage. We reserve the right to modify these Terms at any time. Your continued use of the Service after any such modification constitutes your acceptance of the revised Terms.

2. Description of Service

Dockpage provides an AI-powered platform that enables users to automatically generate professional personal websites by submitting a resume document or a LinkedIn profile URL. The Service uses artificial intelligence to extract, process, and present professional information in the form of a publishable personal website. The Service includes, but is not limited to:

  • AI-generated personal website creation from resume files or LinkedIn profile URLs;
  • Selection and application of visual themes and design styles;
  • AI-assisted content editing and content updates;
  • Website hosting under a Dockpage subdomain or user-configured custom domain;
  • Search engine optimisation (SEO) features for published websites.

Dockpage is a technology service provider only. We do not guarantee the accuracy of AI-generated content, outcomes from publication, or any professional results derived from use of the Service.

3.2 Account Security

You are solely responsible for maintaining the confidentiality of your account credentials, including your password. You are responsible for all activities that occur under your account, whether or not authorised by you. You agree to notify us immediately upon becoming aware of any unauthorised use of your account or any other breach of account security at support@dockpage.io.

4.4 Sensitive Personal Information

You agree not to submit User Content containing sensitive personal information unless strictly necessary and permitted by applicable law, including but not limited to: government-issued identification numbers, financial account details, medical or health information, and information relating to minors.

5. AI-Generated Content Disclaimer

5.1 Nature of AI Outputs

The personal websites and content generated by Dockpage's AI systems are automated outputs based on User Content submitted by you. While Dockpage endeavours to produce high-quality results, AI-generated content may contain inaccuracies, omissions, or errors. You are solely responsible for reviewing, verifying, and editing all AI-generated content before publishing your website.

5.2 No Warranty on Outputs

Dockpage expressly disclaims any warranty, express or implied, as to the accuracy, completeness, fitness for purpose, or reliability of any AI-generated content. The AI-generated personal website is provided as a draft output, and it is your responsibility to ensure the content is accurate, lawful, and appropriate before publication.

5.3 Published Content Responsibility

Once you publish your personal website, you bear full legal responsibility for its content. Dockpage shall not be liable for any claims, damages, or losses arising out of or relating to the content of your published website.

6. Intellectual Property Rights

6.1 Dockpage Platform

All rights, title, and interest in and to the Service, including the underlying technology, AI models, website templates, design systems, software, and documentation, are and shall remain the exclusive property of Dockpage and its licensors. Nothing in these Terms transfers any ownership rights to you.

6.2 Your Website

Subject to your compliance with these Terms, and upon full payment of all applicable fees, you retain ownership of the original personal information and career data you submitted. The generated website output, developed using Dockpage's proprietary AI and templates, is licensed to you for personal, non-commercial use under the terms of your subscription plan. You may not claim ownership of Dockpage's underlying templates, design systems, or AI-generated formatting.

6.3 Feedback

If you provide any feedback, suggestions, or ideas regarding the Service ("Feedback"), you grant Dockpage an unrestricted, perpetual, irrevocable, royalty-free, worldwide licence to use, incorporate, and exploit such Feedback for any purpose without any obligation to compensate you.

7. Prohibited Activities

You agree that you will not, and will not attempt to:

  • (g) resell, redistribute, or sublicence the Service or any portion thereof without prior written authorisation from Dockpage;
  • (h) use the Service in any manner that could damage, disable, overburden, or impair the Service or interfere with any other user's use of the Service;
  • (i) circumvent or attempt to circumvent any access controls, subscription restrictions, or security features of the Service.

8. Subscription, Pricing, and Payments

8.1 Free and Paid Plans

Dockpage offers both free and paid subscription plans. The features available under each plan are described on the pricing page of the website and are subject to change at Dockpage's discretion.

8.2 Payment Terms

By subscribing to a paid plan, you agree to pay all applicable fees as described at the time of purchase. All fees are quoted and charged in the currency displayed at checkout. You authorise Dockpage (or its authorised payment processors) to charge your designated payment method on a recurring basis in accordance with your selected billing cycle.

All fees paid are non-refundable, except where required by applicable law. If you cancel your subscription, you will retain access to paid features until the end of your current billing period, after which your account will revert to the free plan. Dockpage does not issue pro-rated refunds for partial subscription periods.

8.4 Price Changes

Dockpage reserves the right to change subscription pricing at any time. Where required by applicable law, we will provide advance notice of any price increases to existing subscribers.

9. Custom Domain and Third-Party Services

If you configure a custom domain for your Dockpage website, you acknowledge that: (a) domain registration, renewal, and management are your sole responsibility; (b) Dockpage is not responsible for any failure of third-party domain registrars or DNS providers; and (c) you must ensure your domain usage does not infringe any third-party trademark or other intellectual property rights.

Dockpage may integrate with third-party services, including but not limited to LinkedIn, payment processors, and hosting providers. Your use of such third-party services is subject to their respective terms and privacy policies, and Dockpage assumes no liability in connection therewith.

10. Termination

10.1 Termination by You

You may terminate your account at any time through your account settings. Termination does not entitle you to a refund of any prepaid fees.

10.2 Termination by Dockpage

Dockpage reserves the right, at its sole discretion and without prior notice, to suspend or permanently terminate your access to the Service if: (a) you breach any provision of these Terms; (b) your conduct is harmful to other users, third parties, or the integrity of the Service; (c) required by applicable law; or (d) continued provision of the Service to you is no longer commercially viable.

10.3 Effect of Termination

Upon termination of your account, your right to access and use the Service will immediately cease. Dockpage may, but is not obligated to, retain or delete your User Content following termination. Provisions of these Terms that by their nature should survive termination shall do so, including Sections 5, 6, 11, 12, 13, and 14.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. DOCKPAGE DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED FROM DOCKPAGE OR THROUGH THE SERVICE, SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DOCKPAGE, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES WHATSOEVER, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, BUSINESS INTERRUPTION, OR COST OF SUBSTITUTE SERVICES, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF DOCKPAGE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL DOCKPAGE'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE SERVICE EXCEED THE GREATER OF: (A) THE TOTAL FEES PAID BY YOU TO DOCKPAGE IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE CLAIM; OR (B) ONE HUNDRED UNITED STATES DOLLARS (USD $100).

13. Indemnification

You agree to defend, indemnify, and hold harmless Dockpage, its affiliates, and their respective officers, directors, employees, contractors, agents, licensors, and service providers from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable legal fees) arising out of or relating to: (a) your use of or access to the Service; (b) your User Content; (c) your violation of these Terms; (d) your violation of any applicable law or regulation; or (e) any claim that your User Content or your published website infringes the rights of a third party.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. In the event of any dispute, controversy, or claim arising out of or relating to these Terms or the Service, the parties agree to first attempt to resolve the matter through good-faith negotiation. If the dispute is not resolved within thirty (30) days of written notice, either party may pursue resolution through binding arbitration or, where permitted, the courts of the applicable jurisdiction. Nothing in this Section limits either party's right to seek injunctive or other equitable relief from a court of competent jurisdiction.

  • Severability: If any provision of these Terms is held invalid or unenforceable, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall remain in full force and effect.
  • Waiver: Failure by Dockpage to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
  • Assignment: You may not assign or transfer your rights or obligations under these Terms without Dockpage's prior written consent. Dockpage may assign these Terms freely.
